Formany foreigners who are already in China, they must apply for a workvisa if they want to work in China. However, under normalcircumstances, foreigners cannot apply for a work visa directly inChina, and they must leave the country to reapply for it, and itusually takes at least 2-3 months for them to complete all theformalities and start working. However, for some applicants whofulfill special conditions, they can apply directly in China. In thisarticle, SFBC explains which foreigners meet the requirements.

Thosewho meet one of the following circumstances may directly apply for awork permit for foreigners to come to China within the territory, andshall submit all the application materials in accordance with theNotice of Application for Work Permit for Foreigners and theApplication for Work Permit for Foreigners:
符合下列情形之一的，可在境内直接申请外国人来华工作许可，应按申请《外国人工作许可通知》和申领《外国人工作许可证》提交全部申请材料：
(1)High-ranking foreign talents who have entered the country with othervisas or valid residence permits (Category A); (SFBC explains thatany valid visa held by a high-ranking foreign talent can be convertedinto a work visa in the country)
(1)持其他签证或有效居留证件已入境的外国高端人才（A类）；（SFBC解析，外国高端人才持任何有效签证均可在境内转为工作签证）
(2)Foreigners working in China who have changed employers, but whosejobs (occupations) have not changed, and whose work-type residencepermits are within the validity period; (SFBC's analysis is thatforeigners who have changed employers and wish to apply forre-employment in China must do so within one month of thecancellation of their original work permits.)
(2)在华工作的外国人变换用人单位，但工作岗位（职业）未变动，且工作类居留许可在有效期内的；（SFBC解析，变换用人单位的外国人想要在境内申请转聘，必须在原工作许可注销一个月内进行）
(3)Foreign spouses or children of Chinese citizens, or spouses orchildren of foreigners permanently residing or working in China,holding valid visas or residence permits within the validity period;(SFBC's analysis is that, in the case of Chinese citizens, andforeigners residing and working in China, their spouses and childrencan apply for work in China)
(3)中国公民的外籍配偶或子女、在华永久居留或工作的外国人的配偶或子女，持有效签证或在有效期内的居留许可的；（SFBC解析，对于中国公民、在华定居及工作的外国人来说，其配偶及子女可以在中国境内申请工作）
(4)Those in line with preferential policies related to free trade zonesand pilot zones for comprehensive innovation and reform;
(4)符合自由贸易区、全面创新改革试验区相关优惠政策的；
(5)The employer is eligible to enjoy the preferential policies relatedto the regional headquarters of multinational corporations in China;
(5)用人单位符合享有跨国公司在华地区总部相关优惠政策的；
(6)Movement of personnel within the enterprise group;
(6)企业集团内部人员流动的；
(7)Implementation of intergovernmental agreements or accords;
(7)执行政府间协议或协定的；
(8)Representatives of Chinese organizations who have entered China inaccordance with the law with work visas; foreigners who have beengranted work permits to work in China for less than 90 days and havebeen employed by domestic employers in accordance with the law withinthe validity period of their stay;
(8)已持工作签证依法入境的驻华机构代表人员；已获得来华工作90 日以下的外国人来华工作许可，在其停留有效期内，被境内用人单位依法聘用的；
(9)Other approving agencies determined to be eligible.

1.If a foreigner working in China changes his employer, he shall cancelthe existing work permit first.

2.The internal mobility of personnel in the regional headquarters ofmultinational corporations in China and enterprise groups refers tothe mobility of managers and other senior management personnel andprofessional and technical personnel employed by the regionalheadquarters of multinational corporations in China or enterprisegroups in the same positions between the regional headquarters andits wholly-owned or joint-venture branches or subsidiaries that havebeen filed with the licensing decision-making body (between theparent company and its member companies or member companies),including the change to a new position or the promotion ofprofessional positions to executive management positions.professional positions to administrative positions). After thecancellation of the original work permit, the application for a newwork permit shall be submitted within 30 days from the date ofcancellation, and the application form for foreigner's permission towork in China, the employment contract (dispatch letter), the validresidence permit, the information page of the passport and thecertificate of cancellation shall be submitted. 2.跨国公司在华地区总部及企业集团人员内部流动，指跨国公司在华地区总部或企业集团聘用的经理等高级管理人员和专业技术人员，在地区总部与其已向许可决定机构备案的全资或合资的分公司、子公司之间（母公司与其成员公司或者成员公司之间）的相同岗位上流动（包括改任新职务或从专业岗位提升至行政管理岗位）。注销原工作许可后，自注销之日起30日内提交新工作许可申请，应提交外国人来华工作许可申请表、聘用合同（派遣函）、有效居留许可、护照信息页及注销证明。岗位变动的，应补充提交相关工作资历证明。
