(I)Applicable objects

1.用人单位基本条件
(1)Be established according to law with actual business premises, taxpayment, social insurance payment, and no serious violation of lawand dishonesty; the posts shall be those with special needs and notviolating relevant state regulations; the wages and salaries shallnot be lower than the local minimum wage standard.
(1)依法设立，有实际经营场所、依法纳税、缴纳社会保险、无严重违法失信记录；聘用外国人从事的岗位应是有特殊需要，国内暂缺适当人选，且不违反国家有关规定的岗位；支付所聘用外国人的工资、薪金不得低于当地最低工资标准。
(2)If the laws and regulations shall be pre-approved by the competentdepartment of the industry, the approval shall be required.
(2)法律法规规定应由行业主管部门前置审批的，需经过批准。
2.Basic conditions of the applicant
2.申请人基本条件
(1)They shall be at least 18 years of age, be in good health, have nocriminal record, have a definite employer in China, and have thenecessary professional skills or appropriate knowledge level fortheir work.
(1)应年满18周岁，身体健康，无犯罪记录，境内有确定的用人单位，具有从事其工作所必需的专业技能或相适应的知识水平。
(2)The work is in line with the needs of China's economic and socialdevelopment and is urgently needed professionals in China.
(2)所从事的工作符合我国经济社会发展需要，为国内急需紧缺的专业人员。
(3)Where there are other provisions in laws and regulations onforeigners working in China, such provisions shall prevail.
(3)法律法规对外国人来华工作另有规定的，从其规定。
(4)Foreign high-end talent (class A) refers toconform to the "advanced lack" and market demandorientation, China's economic and social development needs ofscientists, science and technology talents, internationalentrepreneurs, special talents and conform to the point integralforeign high-end talent standard talent (refers to the "integralelements score value table", score in 85 points and above theapplicant). Foreign high-end talents are not limited by age,education and work experience.
(4)外国高端人才（A类）是指符合“高精尖缺”和市场需求导向，中国经济社会发展需要的科学家、科技领军人才、国际企业家、专门特殊人才以及符合计点积分外国高端人才标准的人才（指经过“积分要素计分赋值表”打分，分数在85分及以上的申请人）。外国高端人才可不受年龄、学历和工作经历限制。
Foreignprofessionals (category B) refers to the talents who meet the workguidance catalogue and job demand of foreigners in China, and areurgently needed for economic and social development, with bachelor'sdegree or above and 2 years or above working experience, under theage of 60; for the applicants, and the score of 60 points or above[A1]) and the inter-governmental agreement or agreement, therestriction of age, educational background or working experience maybe appropriately relaxed.
外国专业人才（B类）是指符合外国人来华工作指导目录和岗位需求，属于经济社会发展急需的人才，具有学士及以上学位和2年及以上相关工作经历，年龄不超过60周岁；对确有需要，符合创新创业人才、专业技能类人才、符合计点积分外国专业人才标准的（指经过“积分要素计分赋值表”打分，分数在60分及[A1]以上的申请人）以及执行政府间协议或协定的，可适当放宽年龄、学历或工作经历等限制。

1.Notice of Application for Foreign Work Permit before entry
1.入境前申请《外国人工作许可通知》
(1)Application form for work Permit of Foreigners in China: fill in andprint online before entry, sign the signature (copy or fax) of theapplicant, stamp the official seal of the employer or the officialseal of the authorized department and upload it to the system.
(1)外国人来华工作许可申请表：入境前在线填写打印，申请人签字（复印或传真件）后，加盖用人单位公章或经单位授权部门公章上传至系统。
(2)Foreign talent identification materials: According to the"Classification Standards for Foreigners' Work in China(Trial)", relevant certification materials that meet theidentification conditions shall be provided. The applicant shall signin the application form and stamp the official seal of the employer,and agree with the licensing decision body to conduct supplementaryinvestigation according to the needs.
(2)外国人才认定材料：应根据《外国人来华工作分类标准（试行）》，提供符合认定条件的相关证明材料，由申请人在申请表中签字并加盖用人单位公章，同意许可决定机构根据需要进行补充调查。
Throughcounting points to foreign high-end talents (class A) or foreignprofessionals (class B) standard, should provide the correspondinghighest degree (degree) certificate, professional qualification,Chinese level ability (Chinese proficiency test HSK certificate,etc.), working salary of income, work qualifications and countingtable and other materials.
通过计点积分达到外国高端人才（A类）或外国专业人才（B类）标准的，应提供相应的最高学位（学历）证书、职业资格证明、汉语水平能力（中国汉语水平考试HSK证书等）、来华工作年薪的收入证明、工作资历证明材料以及计点积分表等材料。

在涉及薪资事项申请时，应提交单位及申请人承诺书（承诺事项包括外国人的月薪（年薪）、在沪月（年）交税金额、缴税地点等，申请人签字，用人单位加盖公章），受理及决定机构可要求用人单位在办理下次业务时提供相应税单。
(3)Work qualification certificate: issued bythe applicant worked unit engaged in and now employed jobs relatedwork experience certificate, including position, working hours orhave done the project, the applicant work seal or the head of thesignature, and have proof contact valid contact number or E-mail.Applicants who meet the standard of foreign talents with point pointsshould provide a certificate of work experience that meet the numberof points.
(3)工作资历证明：由申请人原工作过的单位出具从事与现聘用岗位工作相关的工作经历证明，包括职位、工作时间或曾经做过的项目，需申请人原工作单位加盖公章或负责人签字，并留有证明联系人有效联系电话或电子邮件。符合计点积分外国人才标准的申请人需出具满足积分年限的工作经历证明。
Foreignhigh-end talents who meet the Classification Standards for Foreignersin China (Trial) (category A) (1) are selected into the domestictalent introduction plan; (2) foreign high-end talents who meet theinternational recognized professional achievement standards, whichadopts the commitment system. Other those who meet the standards offoreign high-end talents (Class A) still need to provide proof ofworking qualifications. If the applicant wins a well-known award inthe professional field, the corresponding award proof materials canbe provided.
外国高端人才符合《外国人来华工作分类标准(试行）》外国高端人才（A类）（一）入选国内人才引进计划的；（二）符合国际公认的专业成就认定标准的外国高端人才，该项采用承诺制。其他达到外国高端人才（A类）标准的仍需提供工作资历证明。如申请人在专业领域知名奖项获奖，可提供相应获奖证明材料。
(4)Certificate of highest degree (degree) and certification materials:the highest degree (degree) shall be obtained abroad by our embassyor consulate or by the applicant; the certificate of highest degree(education) obtained in Hong Kong, Macao and Taiwan shall becertified by China or notarized by the local notary office; for thehighest degree (education) certificate obtained in China, only theoriginal certificate of academic degree (degree) shall be provided.Among them, foreign high-end talents who meet the ClassificationStandards for Foreigners' Work in China (Trial) (Class A) (1) areincluded in the domestic talent introduction plan; (2) meet theinternationally recognized standards for identifying professionalachievements; (3) foreign talents who meet the requirements ofmarket-oriented encouraged positions; (4) innovative andentrepreneurial talents shall adopt the commitment system.
(4)最高学位（学历）证书及认证材料：最高学位（学历）证书在国外获得的，应经我驻外使、领馆或由申请人获得学位（学历）所在国驻华使、领馆或我国学历认证机构认证；最高学位（学历）证书在港澳特别行政区和台湾地区获得的，应经我国学历认证机构认证或经所在地区公证机构公证；最高学位（学历）证书在中国境内获得的，仅提供学历（学位）证书原件。其中，外国高端人才符合《外国人来华工作分类标准(试行）》外国高端人才（A类）（一）入选国内人才引进计划的；（二）符合国际公认的专业成就认定标准的；（三）符合市场导向的鼓励类岗位需求的外国人才；（四）创新创业人才的，该项采用承诺制。
(5)Relevant approval documents and professional qualificationcertificate: According to the laws and regulations of the country,the approval documents or professional qualification certificate; theforeign professional qualification certificate shall be certified byour embassy or consulate, or the original of the professionalqualification certificate; the original certificate obtained in theHong Kong and Macao Special Administrative Region and Taiwan Region,the original shall be notarized by the notary office of the region.
(5)相关批准文书、职业资格证明：我国法律法规规定应由行业主管部门前置审批或具备我国相应准入类职业资格的，应提供行业主管部门批准文书或职业资格证明；国外专业资格证明，应经我驻外使、领馆认证，或获得专业资格证明所在国的驻华使、领馆认证或公证机构对原件公证；职业资格证明在港澳特别行政区和台湾地区获得的，应经所在地区公证机关对原件公证。
(6)Certificate of no criminal record and certification materials:foreign high-end talents (Class A) this item adopts the commitmentsystem. Foreign professionals (category B) shall be issued by thepolice, security and court departments of the applicant's nationalityor habitual residence and certified by our embassies or consulates orforeign embassies or consulates (habitual residence refers to thecountry or region where the applicant has left the country ofnationality for more than one year, not including China); thecertificate of no criminal record issued in the Hong Kong and Taiwanregion shall be notarized by the local notary office. No criminalrecord should be issued within 6 months. Do not accept a sworn nocriminal record with no criminal record. Non-oath without criminalrecords issued by foreign affairs (including foreign embassies andconsulates in China) can be received directly and no longercertified.
(6)无犯罪记录证明及认证材料：外国高端人才（A类）该项采用承诺制。外国专业人才（B类）应当由申请人国籍国或经常居住地警察、安全、法院等部门出具，并经我驻外使、领馆认证或外国驻华使、领馆认证（经常居住地指申请人离开国籍国最后连续居住1年以上的国家或地区，不包括在中国境内）；在港澳特别行政区和台湾地区出具的无犯罪记录证明，应经所在地区公证机关公证。无犯罪记录签发时间应在6个月内。不接收仅为本人声明无犯罪的宣誓性无犯罪记录。外交（含外国驻华使、领馆）出具的非宣誓性无犯罪记录可直接接收，不再认证。
(7)Physical examination certificate: the verification certificate ofphysical examination record or health examination certificate issuedby the Chinese inspection and quarantine institution shall be issuedwithin 6 months. Before entry, the commitment system can be adoptedand the physical examination commitment letter can be provided.
(7)体检证明：由中国检验检疫机构出具的境外人员体格检查记录验证证明或健康检查证明书，签发时间均在6个月内。入境前可采用承诺制并提供体检承诺书。
(8)Employment contract or employment certificate: The Chinese contractshall be provided, which shall be signed by the applicant and affixedwith the official seal of the company, and shall not be altered. Theemployment contract or employment certificate (including the dispatchletter of a multinational company) shall include the working place,working content, salary, working hours in China, position, and sealpage (signature). The certificate of employment is applicable tointergovernmental or international organization agreements, chiefrepresentatives and representatives of various representative officesin China and overseas contract service providers. The applicablesituation of the dispatch letter is that the senior manager andprofessional management personnel from the headquarters of themultinational company or regional headquarters to work in thedomestic subsidiary or branch, which shall be issued by theheadquarters or regional headquarters of the multinational company.If the employment certificate (including the letter of dispatch)lacks the necessary contents, a supplementary certificate shall beissued separately. If a multinational company sends managers andother senior managers and professional and technical personnel to theheadquarters in China to work in its domestic subsidiaries orbranches, it shall submit a letter of dispatch and the employmentcontract signed with the headquarters of a multinational company inChina.
(8)聘用合同或任职证明：应提供中文合同，应由申请人签名并加盖单位公章，不得涂改。聘用合同或任职证明（包括跨国公司派遣函）应当包括工作地点、工作内容、薪酬、来华工作时间、职位、盖章页（签字）必要内容。任职证明适用执行政府间、国际组织间协议或协定人员、各类驻华代表处首席代表及代表及境外合同服务提供者。派遣函适用情形为跨国公司总部或地区总部从境外派遣经理等高级管理人员和专业技术人员至境内子公司或分公司任职，由跨国公司总部或地区总部出具。任职证明（包括派遣函）如缺少必要内容，需另行出具证明补充说明。跨国公司在华地区总部派遣经理等高级管理人员和专业技术人员至境内子公司或分公司任职的，提交派遣函以及与跨国公司在华地区总部签订的聘用合同。
(9)Applicant's passport or international travel document: passport orinternational travel document information page. The passport shallnot be valid for less than six months.
(9)申请人护照或国际旅行证件：护照或国际旅行证件信息页。护照有效期不得少于6个月。
(10)Front bareheaded photo of the applicant within 6 months: recentbareheaded electronic photo, white background, no bezel, completefacial features, clear image, no spots, defects, printing and inkdefects. Hats or headscarves are not recommended. If you have to wearthem for religious reasons, ensure that it does not cover the entireface of the applicant.
(10)申请人6个月内正面免冠照片：近期免冠电子照片，白色背景，无边框，面部特征完整，图像清晰，无斑点、瑕疵、印墨缺陷。不建议戴帽子或头巾等饰物，如因宗教原因不得不戴，应确保其不遮挡申请人整个面部。
(11)The accompanying family related documents:including accompanying family passport (or international traveldocuments) information page, family relationship certificate (spouse,marriage certificate, children, children birth certificate oradoption, parents or spouse parents, the applicant birth certificateor marriage certificate or notarial certificate), medical report(over 18 years of family) and electronic photos (requirementsconsistent with the main applicant). The accompanying family membersinclude the spouse, children under the age of 18, parents and parentsof the spouse.
(11)随行家属相关证明材料：包括随行家属护照（或国际旅行证件）信息页、家属关系证明（配偶—结婚证书，子女—子女出生证明或收养证明，父母或配偶父母—申请人出生证明或结婚证书或公证证明）、体检报告（18周岁以上家属）以及电子照片（要求与主申请人一致）。随行家属包括配偶、未年满18周岁的子女、父母及配偶父母。
(12)Other materials: supplementary materials provided by the licensingacceptance agency or the decision agency as required.
(12)其他材料：许可受理机构或决定机构根据需要要求进行补充提供的材料。
2.Apply for the Work Permit for Foreigners after entry
2.入境后申请《外国人工作许可证》
(1)The applicant's physical examination certificate: the verificationcertificate of the physical examination record or the healthexamination certificate issued by the Chinese inspection andquarantine institution, which shall be issued within 6 months.
(1)申请人体检证明：由中国检验检疫机构出具的境外人员体格检查记录验证证明或健康检查证明书，签发时间在6个月内。
(2)Valid visa or valid residence permit: after entry, upload thepassport (or international travel document) visa page, the latestentry work signature page or residence permit information page.
(2)申请人有效签证或有效居留许可：入境后补充上传护照（或国际旅行证件）签证页、最近的入境工作签章页或居留许可信息页。
(3)Other materials: supplementary materials provided by the licensingacceptance agency or the decision agency as required.
(3)其他材料：许可受理机构或决定机构根据需要要求进行补充提供的材料。
