知乎有人问为什么中国的大学教材都写得那么差劲不利于自学。
我想说,别的学科专业我不清楚,但至少在法律方面,外国的教材也未必就有利于自学……
以美国法学院通用的教材为例。
美国法学院各科目通用的教材,通常是casebook。每本都又大又厚。比如本人当年的民诉法casebook,就是letter纸页面(大致相当于A4纸),有1400页。里面一大半的篇幅都是各种判决书(也就是判例),只有篇幅极少的讲解与提示。而美国法院的判决书,基本上都是极其晦涩难懂的,还间杂拉丁语、法语的词句。有的一句话,各种从句、插入语,套来套去,然后一句话能在教材中占地10行以上。国内英语考试所谓“长难句”,跟它们一比,简直就是小巧玲珑。下面举个例子,看看谁能看懂它在说啥。

所以在美国的法学院,学乖了的学生们,也会找各种教辅书来代替casebook这种相对“官方”的教材。比如说,比较受欢迎的一套叫做“Examples & Explanations”系列(例子与解释,简称“E&E”,如图就是民事诉讼法的一个E&E,不过版本有点老了)。这些辅导书是用浅显易懂的语言讲解法律规范的含义与理性基础,而不是直接把判决书原文像一盆狗血浇下来糊你一脸。
所以说,国外也有基本上无法用来自学的教材,这并不是中国特产……
