CUBILOSE AGREEMENT BETWEEN CHINA AND MALASIA
中国与马来西亚燕窝协议
Article One: The Ministry of Agriculture and the Ministry of Health of Malaysia are responsible for the inspection and quarantine of the export of cubilose products to China, and the Ministry of Agriculture of Malaysia issue a certificate of veterinary hygiene and the Ministry of Health of Malaysia issue a sanitary certificate.
第一条：马来西亚农业部和卫生部负责对向中国输出燕窝产品的检验检疫工作，并由大马农业部出具兽医卫生证书，马来西亚卫生部出具卫生证书。
Article Two: Exporters and agents of cubilose products exported to China should be approved by the Malaysian authorities and reported to the China’s relevant authorities for putting on file.
第二条：输华燕窝产品的出口商及代理商，须经马方主管部门认可，并报中方备案。
Article Three: The production and processing of the cubilose products exported to China shall comply with the relevant regulatioins of inspection / quarantine and food safety of China and Malaysia. The swallow nest of cubilose products exported to China should be registered by Malaysian competent authorities and reported to Chinese authorities for putting on file. Processing enterprises exporting cubilose products to China shall be registered by the State Authentication and Accreditation Administration of China (CNCAA) in accordance with the regulations of the people's Republic of China on Registration of Foods Imported From Abroad. Only the processing enterprises registered with CNCA are permitted to export cubilose products to China.
第三条：输华燕窝产品的生产、加工过程须符合中国和马来西亚有关检验检疫及食品安全规定。输华燕窝产品的燕屋须经马方主管部门註册，并报中方备案；输华燕窝产品的加工企业，须由中国国家认证认可监督管理局（CNCA）根据中华人民共和国《进口食品国外生产企业註册管理规定》进行注册，只有获得CNCA注册的加工企业，才允许向中国出口燕窝产品。
Article Four: Malaysia relevant authoritie is responsible for providing China’s relevant authoritie with the regulations and standards for the production and processing of cubilose products, in addition to the inspection and quarantine items, methods, procedures and standards for cubilose products exported to China.
第四条：马方负责向中方提供燕窝产品生产和加工管理的法规和标準，以及输华燕窝产品的检验检疫项目、方法、程序和标准。
Article Five: Malaysian relevant authorities should establish the epidemic prevention and hygiene management system for the swallow nest, and formulate the procedures for the operation of hygiene control in the collection and transportation of cubilose products, formulate and implement the annual animal epidemic surveillance plan and the toxic and harmful substances monitoring plan related to the quarantine / hygiene and food safety of export cubilose products, and within three months of completion of the plan, will inform the relevant authorities of China of contents of the plan and a summary of annual implementation.
第五条：马方应建立燕屋防疫及卫生管理制度，制定燕窝采收和运输卫生控制操作程序，制定并执行与出口燕窝产品检疫卫生和食品安全相关的年度动物疫情监控计划和有毒有害物质监控计划，并在计划完成3个月内，向中方通报有关计划内容和年度执行情况总结。
Article Six: The processing enterprises of cubilose products exported to China should establish its swallow nest tracing system from nest to export to ensure that the products can be traced back and recall the relevant products in time when problems occur.
第六条：输华燕窝产品加工企业应建立从燕屋到出口的燕窝追溯体系，确保产品可追溯并在发生问题时，能及时召回相关产品。
Article Seven: The relevant authorities of China have implemented the quarantine examination approval system on imported cubilose products, the products failing to acquire the approval can not be permitted to enter China, however except for ready-to-eat cubilose products, such as canned products by deep procdessed.
第七条：中方对进口燕窝产品（经深加工并製成罐头等即食燕窝产品除外）实施检疫审批制度，未获审批不得入境。
Article Eight: On the exterior and interior packing of the cubilose products exported to China shall be in English and Chinese, indicating description of commodity, weight, name of swallow nest and the registration number thereof, the name, address and registration number of the processing enterprise, product storage conditions, production date and other relevant information. Identification of concerned product information should conform to China laws, regulations and relevant standards / requirements.
第八条：输华燕窝产品的内外包装要用中英文表明品名、重量、燕屋名称及注册号、加工企业名称、地址及注册号、产品储存条件和生产日期以及其他相关信息，有关产品信息的标识须符合中国法律法规及相关标准和要求。
Article Nine: Each batch of cubilose products exported to China shall be accompanied by a copy of certificate of origin and a original copy of veteranary certificate. The certificate of origin and veteranary certificate shall be written in Chinese and English, and the format and content thereof shall be approved by both parties in advance; The veterinary certificate and hygine certificate issued by the relevant authorities in Malaysia shall indicate the registration number of the swallow nest, the registration number of the processing enterprise, the source of raw materials of the product, and that necessary preventive measures have been taken to prevent the products from being exposed to all avian influenza virus sources. The products comply with Chinese laws and regulations and relevant standards and requirements, and are suitable for human consumption; the relevant Malaysian authorities shall promptly submit the sign handwriting, certificate samples of relevant official certification agencies and authorized signatories, and other information to the relevant authorities in China for the record and any change or replace thereof shall be notified to Chinas relevant authorities on one month in advance.
第九条：向中国输出的每一批燕窝产品，应随附一份原产地证书和正本兽医卫生证书、卫生证书。兽医卫生证书、卫生证书用中文和英文写成，其格式、内容须事先获得双方认可；马方出具的兽医卫生证书、卫生证书，须註明燕屋註册号、加工企业註册号、产品原料来源，已采取必要的预防措施防止产品与所有禽流感病毒源接触，产品符合中国法律法规及相关标准和要求，适合人类食用；马方应及时将有关官方出证机构、授权签署人签字笔迹、证书样本等资料提供中方备案，如有更改、更换，应提前一个月向中方通报。
Article Ten: The relevant authorities of China shall implement inspection and quarantine for entry product. Only the product which in conformity with China laws and regulations can enter the country.
第十条：中方在产品入境时实施检验检疫，产品符合中国法律及相关标准和要求，方可入境。
Article Eleven: Provided that the relevant authorities of China find any circumstances which not in conformity with the provisioins hereof, have the right to seize, return, destoy or otherwise dispose of the relevant products, and circulate a notice to the relevant Malaysia authorities. In the event of an avian flu outbreak in Malaysia, Malaysian authorities should promptly notify Chinese authorities, and effect suspension of export to China and recall the products which may have been affected.
The relevant authorities of China will effect assessment on the avian flu situation of the relevant departments in Malaysia and require the cubilose product processing enterprises exported to China to equip the corresponding heat treatment facilities, the cubilose products exported to China shall be effectively heated to kill avian influenza by the way of "at a central temperature of not less than 70 degrees Celsius for at least 3.5 seconds"; Malaysian authorities will only continue to export cubilose products to China after assessing that the Malaysian authorities are able to ensure the safety of cubilose products exported to China.
The relevant authorities in China have the right to ban the import of related products in case of avian flu outbreak in Malaysia.
If a major outbreak (excluding avian flu) or food safety incidents occurs in Malaysia affecting product safety, the relevant Malaysian authorities should without undue delay inform the relevant Chinese authorities, and suspent the export of and recall the products that may be affected, if the export to China is to be resumed, the relevant departments of China must be notified in advance before acquirement of an acknowlegement from he relevant departments of China. The relevant authorities of China have the right to ban and prohibit the import of related products when such aforementioned circumstances occur.
第十一条：中方发现不符合本议定书规定情况时，有权对相关产品实施扣押、退货、销毁或其他处理，并通报马方；马来西亚国内发生禽流感疫情时，马方应及时向中方通报，停止对华出口并召回可能受影响的产品。
中方将对马方禽流感情况进行评估，要求输华燕窝产品加工企业具备相应的热处理设施，输华燕窝产品须经过“中心温度不低于摄氏70度加热至少3.5秒”的杀灭禽流感的有效加热处理；经评估马方能确保输华燕窝产品安全後，马方方可继续对华出口燕窝产品。
中方有权在马来西亚发生禽流感疫情时禁止进口相关产品。
马来西亚国内发生影响产品安全的重大疫情（不包括禽流感）或食品安全事件，马方应及时向中方通报，停止对华出口并召回可能受影响的产品，如需恢复对华出口须事先通报中方确认。中方有权在上述情况发生时禁止进口相关产品。
Article Twelve: after the signature of this Protocol, the relevant authorities of China will, with the assistance of the relevant Malaysian authorities, send personnel to Malaysia for a field inspection of the cubilose hygiene control system in Malaysia, the triffic, accommodation and living expenses of the inspection personnel in China are borne by the Malaysian authorities. The China’s authorities will make a biennial inspection of the implementation of the cubilose food safety management and quarantine / hygiene control measures in Malaysia. The above-mentioned inspection may be carried out at any time if necessary, for which the relevant Malaysian authorities shall assist and cooperate.
第十二条：本议定书签署後，中方将在马方的协助下，派员赴马来西亚，对大马燕窝卫生控制体系进行实地考察，中方考察人员交通、食宿和生活费用由马方承担。中方每两年对马方的燕窝食品安全管理和检疫卫生控制措施执行情况进行一次实地考察。根据需要，上述考察可随时进行。马方应予协助和配合。
Article Thirteen: "Cubilose products" for the purposes of this Protocol refer to as any cybilose and the products thereof formed from the saliva of esculent swift and the same type of swallow, which has removed dirt and feathers and is suitable for human consumption.
第十三条：本议定书中的“燕窝产品”指：由金丝燕及相同类型燕子唾液形成、已去除污垢和羽毛、适合人类食用的燕窝及其製品。
Article Fourteen: This Protocol may be amended by mutual agreement.
第十四条：本议定书经双方协商同意，可以修改。
Article Fifteen: This Protocol shall be valid and remain in force 5 years, and shall automatically be extended for 5 years if one party, within two month before the expiration of valididy, has not notified the other Party in writing of its intention to amend or terminate this Protocol.
This Protocol, in English and Chinese, in duplicate, equally authentic, signed by the parties hereto at Nanning on September 19th 2012 with effect from the date of signature.
In case of any inconsistencies, the English version shall prevail.
第十五条：本议定书有效期5年，有效期满前两个月内，如果一方未书面通知另一方欲修改或终止本议定书，则议定书有效期自动延长5年。
本议定书用英文、中文写成，一式两份，二种文本同等作準，2012年9月19日在南宁签署，自签字之日起生效。
如有异议，以英文本为准。
