After consulting with our top government health professionals, I have decided to take several strong but necessary actions to protect the health and wellbeing of all Americans.

经过这段时间的反复对比，本人发现现在太多人实在是太忙了，根本没时间去自己研究一下各种概念到底是怎么回事，SO，我们就每次找个重点概念来进行一下科普：

政府紧急状态：National Emergency

在美国，现在的"政府紧急状态"起源于1976年美国总统福特签署的《美国全国紧急状态法》。在该法中，规定了美国总统宣布国家进入紧急状态下拥有的至少136项紧急权力，涉及到生产方式调控、向国外派兵、实行国内戒严、管制企业运营等，甚至可以在一定条件下重新使用化学和生物*器武**。

但同时，该法也制定了国会对总统宣布紧急状态的平衡机制。但事实上，该法从未规定总统到底应该在何种条件下，可以宣布紧急状态。因此，美国历届总统都会衡量国会的压力以及听取智囊团队对既有法律尤其是美国宪法的解读，以此决定自己是否需要启动全国紧急状态。

在《全国紧急状态法》宣布之后，该法更成为了政府的工具。因为该法最大的作用是，为总统进行更多的权力授予。事实上，自该法宣布之后，历届总统至少53次宣布国家进入紧急状态，而多数紧急状态法至今依然有效。

例如1979年伊朗发生伊斯兰革命，伊朗扣留了美国52名人质，在人质危机发生之后，美国总统卡特宣布国家进入紧急状态，而至今，紧急状态仍未过时。

再比如2001年9月，美国遭遇恐怖袭击。美国总统小布什发布了全国紧急状态令，该紧急状态令确定了应对恐怖主义威胁应采取的相关举措。

后来被美国总统奥巴马延期6次，成为目前美国进行反恐战争以及海外派兵打击恐怖分子的法律依据。

由此可见，《紧急状态法》可以授予总统在特殊状态下或者国家危机下，可以绕过国会进行决定的权力。

但同时可以关注到，紧急状态通常只在战争、国防危机和国家遭遇紧急危机时出现。

历史上的紧急状态

虽然美国宪法对于紧急状态并无明确规定，但实际上，美国总统在历史上曾多次宣布全国紧急状态。美国法学家和政治学家曾多次为总统实行紧急状态寻找依据，并声称总统的宣布紧急状态权来源于1787年美国宪法的第1条第8、9款以及第2条第1、2款，即宪法对于战争权、行政权和人身保护令的相关规定。

而在美国宪法中同时规定，总统为美国三军和民兵的总司令，因此在法律上合理化了总统作为总司令的行政权力。而历史上的美国紧急状态，也大多与军事或国家危机有关。

在《美国全国紧急状态法》颁布之前，美国历届总统就有过宣布国家处于紧急状态的先例。

• 如1933年，美国总统罗斯福为了应对世界经济危机和经济大萧条，宣布国家处于紧急状态。凭借紧急状态下授予的权力，美国制定了《全国产业复兴法》，对于经济生产方式、企业运营等进行了部署。
• 1950年，美国总统杜鲁门为了应对朝鲜战争，宣布全国处于紧急状态，通过成立国防动员局，对物资生产、国内物价等进行管制，对国内安全进行约束。

美国各州宣布进入紧急状态是什么意思？

当州长或市长认为已经发生或将会发生的灾难，会严重到需要州补助地方资源的时候，就会宣布地方进入紧急状态（State of Emergency）。紧急状态会允许州或城市的领导人敦促下属各级政府采取行动。根据州和领土卫生官员协会（ASTHO）网站的信息，在宣布紧急状态后可以采取以下行动：

• 激活州应急计划和互助协议。
• 激活州紧急行动中心和事件指挥系统（ICS）。
• 有权动用资金并部署人员、设备、物资和库存。
• 对参与响应活动的人员激活法定豁免和责任保护。
• 暂停和免除规章制度（及法令，如果允许的话）。
• 简化州行政程序，例如采购要求等。

有必要缩减或关闭州政府，州长将通过媒体向内阁发布公告，如暴风雪期间。
